Upton Carpet Cleaners Terms and Conditions
These Terms and Conditions set out the basis on which Upton Carpet Cleaners provides carpet cleaning, upholstery cleaning and related domestic or commercial cleaning services in the United Kingdom. By making a booking, confirming an appointment, or allowing our team to begin work, the customer agrees to these terms. They are designed to explain how our carpet cleaning service operates, what is included, how payment works, and what responsibilities each party has before, during and after the service.
In these Terms and Conditions, references to “we”, “us”, and “our” mean Upton Carpet Cleaners, and references to “you” and “your” mean the customer, whether acting as an individual, landlord, tenant, business, managing agent, or other authorised person. These terms apply to all orders unless we agree otherwise in writing. If any term is found to be unlawful or unenforceable, the remaining terms will continue in full force.
We may update these Terms and Conditions from time to time to reflect changes in our operations, legal duties, or service standards. The version in force at the time of your booking will normally apply to that booking, unless a change is required by law. It is your responsibility to read and understand these terms before confirming any instruction for carpet cleaners or related cleaning work.
All services are subject to availability and to a pre-agreed scope of work. Our quotations and prices are based on the information you provide, including room sizes, carpet type, level of soiling, access conditions, parking arrangements, and any special requirements. If the actual conditions differ materially from the information supplied, we may revise the price, amend the timing, or decline to proceed where it would be unsafe or impractical to do so.
Booking process begins when you provide details of the required cleaning service and we confirm whether we can attend. A booking is not confirmed until we have accepted your request, provided an indicative or fixed price where applicable, and received any required deposit or pre-authorisation. You must ensure that all information you provide is accurate, complete, and current. If you request the cleaning of delicate fibres, stain treatment, odour treatment, or specialist stain removal, you must disclose this in advance so we can assess whether the work is suitable.
When the booking has been accepted, we will provide the date, approximate arrival window, and any conditions attached to the visit. Because cleaning times may vary depending on the state of the carpet or upholstery, our arrival times are estimates rather than guarantees. You agree to allow reasonable access to the property and to ensure that someone authorised is present where necessary to approve the work, answer questions, and confirm completion.
We reserve the right to refuse or cancel a booking where we suspect fraud, where the property presents a health and safety risk, where the instructions are unclear, or where we are unable to carry out the service with reasonable care and skill. If a booking is made on behalf of a business or landlord, the person making the booking confirms that they have authority to do so and to bind the relevant party to these terms.
Payments must be made in accordance with the price agreed at booking or the final price calculated after inspection, where the service is priced on that basis. Unless otherwise stated, payment is due on completion of the service on the same day. We may require a deposit for larger or specialist jobs, and any deposit may be non-refundable in the event of late cancellation or failure to provide access. We accept the payment methods notified to you at the time of booking, and any card processing or transfer fees imposed by a third party remain your responsibility unless we agree otherwise.
If additional work is requested on site, including extra rooms, additional stain treatments, or extended drying-related tasks that were not included in the original quotation, we will tell you if this changes the price before proceeding. The Upton Carpet Cleaners team will not be obliged to carry out additional services without your agreement. Invoices not paid when due may attract reasonable late payment charges, interest, or recovery costs to the extent permitted by law, especially for business customers.
All prices are stated in pounds sterling unless otherwise agreed. Any estimate is given in good faith but may be adjusted where the customer has omitted relevant facts or where the condition of the carpet cleaning work proves substantially different from the description given. Where a written quotation is marked as valid for a limited period, the price may change after that period expires. Promotions or discounts cannot be combined unless we expressly allow it.
Cancellations must be made as early as possible. If you cancel with sufficient notice, we may allow you to reschedule without charge, subject to availability. If you cancel after we have incurred costs, prepared specialist equipment, or allocated labour for your appointment, we may retain part or all of any deposit or charge a cancellation fee that reasonably reflects our losses. If you are unavailable at the agreed time, deny access, or fail to provide the information needed to carry out the service, this may be treated as a late cancellation or failed appointment.
We may cancel or reschedule a booking if staff illness, travel disruption, equipment failure, adverse weather, unsafe conditions, or other events outside our control prevent us from attending as planned. In such cases we will aim to offer a new appointment at the earliest reasonable opportunity. We will not be responsible for indirect losses caused by a change of date, provided we act fairly and in good faith.
The customer must prepare the area before work begins. This includes removing fragile items, valuables, toys, breakables, and personal possessions from the immediate work area, as well as arranging suitable parking and access where necessary. We may move light furniture at our discretion, but we are not required to move heavy, fixed, or hazardous items. Where items remain in the room, you accept the risk of minor disturbance during the cleaning process unless we have agreed otherwise in writing.
Liability is limited to the exercise of reasonable care and skill in providing the service. We will use appropriate methods and products for the fabric or surface being treated, based on the information available to us. However, natural wear, pre-existing damage, colour loss, shrinkage, hidden stains, fraying, dye transfer, or fibre weakness may become apparent during or after cleaning. Some results depend on material condition and age, and we cannot guarantee the removal of every stain or odour. Carpet cleaner treatments may improve appearance significantly without restoring items to a “like new” condition.
We are not liable for damage caused by pre-existing defects, unsuitable materials, incorrect information supplied by the customer, or failure to follow our aftercare advice. We are also not responsible for delays in drying caused by poor ventilation, damp conditions, customer use of the treated area too soon, or other factors beyond our control. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.
If a claim arises, you must notify us within a reasonable time and provide evidence such as photographs and a description of the issue. You must also allow us a reasonable opportunity to inspect the concern and, where appropriate, carry out a re-clean, corrective treatment, or other proportionate remedy. Any remedy we provide is without admission of liability unless we expressly state otherwise. To the extent permitted by law, our total liability for any single claim will not exceed the amount you paid for the specific service giving rise to the claim.
Waste regulations apply to the materials and residues generated during our work. We will dispose of waste arising from our operations in a lawful and responsible manner, in accordance with applicable UK environmental and waste management requirements. This may include packaging, disposable cloths, recovered debris, waste water where lawful disposal is required, and residues from cleaning agents. We will not remove household waste, hazardous waste, clinical waste, asbestos, chemicals, needles, or other regulated materials unless this has been expressly agreed and can lawfully be handled by us.
Where waste must be separated, contained, or transferred to an authorised facility, you agree to cooperate with reasonable instructions. If the property contains hidden contamination, mould, bodily fluids, pests, or other hazardous materials, we may suspend the service immediately. Any additional compliance costs, specialist disposal charges, or safety measures required because of such materials may be charged to you where permitted by law and where they arise from conditions not disclosed in advance.
We reserve the right to use subcontractors or temporary personnel to perform all or part of the service, provided they are suitably instructed and the service standard remains consistent with our obligations. You agree that access, electrical supply, water supply, and a reasonably safe working environment will be provided without charge unless otherwise agreed. If these are unavailable, the appointment may need to be postponed or additional charges may apply.
Customer responsibilities include providing truthful information, ensuring lawful access to the premises, and removing or protecting items that may be sensitive to moisture or cleaning solutions. You are responsible for making us aware of pets, children, alarms, fragile materials, and any restrictions relevant to the property. If you instruct us to proceed despite a warning, you do so at your own risk except where we have acted negligently or unlawfully.
Any estimated completion time is an estimate only. The actual duration of a carpet cleaning job depends on room layout, soil level, fabric type, drying conditions, and whether additional treatment is required. We will aim to complete the work within the agreed visit, but we do not guarantee a fixed end time unless expressly stated. If the work cannot be completed within the booked period, we may offer to continue at a later time or on another day, subject to agreement.
If a customer is a consumer, they may have rights under the Consumer Rights Act 2015 and other applicable legislation. Nothing in these terms is intended to reduce or remove statutory rights. If any provision conflicts with mandatory consumer law, the law will prevail and the conflicting provision will be treated as amended to the minimum extent necessary. Business customers may not rely on consumer rights that do not apply to them.
These Terms and Conditions are governed by the laws of England and Wales. If you are based in Scotland or Northern Ireland, mandatory local rules may also apply where relevant. Any dispute, claim, or issue arising out of or in connection with the service will be subject to the exclusive jurisdiction of the courts of England and Wales, unless the law requires otherwise. This applies to the interpretation, enforcement, and validity of the agreement.
General provisions include the following: any failure by us to enforce a term immediately does not mean we waive our right to do so later; no third party may enforce these terms unless expressly stated; and any communication relating to the service should be treated as part of the contractual record where lawfully retained. Headings are included for convenience only and do not affect interpretation. By booking or accepting the service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions for Upton Carpet Cleaners.
